Brian Edward Walters

Brian Walters advocates for heavy duty incident management towing companies, hazmat companies, and vehicle storage facilities. Mr. Walters has over 14 years of experience in the towing, storage, hazmat, and recovery industry. He has worked with clients across the state, filing suits against motor carriers, insurers, and other businesses who had a responsibility to pay for his clients fees but chose to ignore that obligation. Brian’s work these days focuses exclusively on working in the towing, hazmat, and recovery industry to get clients paid for clearing crash scenes of all sizes and storing vehicles.

Brian has published two law review articles on Texas towing law. His first examined the regulation of private property towing in Texas and discussed consumer remedies. His second dispelled a long-held misconception about tow hearings in Texas and their categorization by Justice Courts as “administrative” in nature. He has also presented at many towing conferences, including the American Towman TowExpo and at conferences for Southwest Tow Operators.

Brian graduated from South Texas College of Law Houston in 2006 with honors. He was a member of the South Texas Law Review, the Order of the Lytae, and received the Highest Grade Award in Corporate Finance and Evidence.

Prior to focusing his practice on towing, hazmat, and storage law, Brian’s work included complex business transactions and litigation, conducting private securities offerings, mergers, corporate reorganizations, and asset acquisitions.

David M. Walters

David Walters practices business litigation at The Walters Firm, PLLC. His practice focuses on transportation law related to towing, hazmat and vehicle storage storage claims and related insurance coverage disputes. Mr. Walters has handled numerous lawsuits and administrative matters from inception to trial as well as associated appeals.

David graduated from South Texas College of Law Houston and attended undergrad at TCU. David is a board member at Uprise Circus, a nonprofit that uses circus arts as a tool for fostering personal and social development with kids. While in law school, David worked provided volunteer legal services through Texas Accountants and Lawyers for the Arts, where he earned a pro-bono honors award.

Jonathan W. Charnitski

Jonathan W. Charnitski represents individuals and businesses with a focus on commercial litigation, business general counsel, and real estate and practices in state and federal courts.

While Jonathan boasts a broad range of legal experience, from structuring multi-million-dollar business acquisitions to representing a Texas county in litigation against the Texas Railroad Commission, he is by nature a litigator. An erstwhile associate of the Walters Firm from 2013-2015, Jonathan rejoined the firm as a partner in 2022 after spending seven years honing his civil litigation skills, primarily in real estate and construction defect litigation. Prior to entering private legal practice in Texas, Jonathan covered telecommunications and intellectual property as a journalist on Capitol Hill in Washington, D.C., worked to right the housing market in governance and compliance at Fannie Mae during the housing market recovery, and was involved as an attorney in large-scale litigation and government investigations. He has been practicing law in Austin since 2013.

Mr. Charnitski earned his J.D. in 2008 from Villanova School of Law outside of Philadelphia, Pennsylvania, where he was President of the Intellectual Property Law Society and research assistant for Professor Penelope Pether. He holds a B.A. in Journalism from the University of Washington in Seattle, where he earned national recognition from the Society of Professional Journalists as an opinion writer and from the Associated College Press as Editor-in-Chief of The Daily.

In his spare time, Mr. Charnitski enjoys playing guitar, running, rooting for the Washington Huskies, and attempting to tame his back yard with his wife.
