David's sudden departure has left an irreplaceable void in the lives of all who knew him. His brilliant legal mind, his unwavering commitment to justice, and his genuine compassion for others made him an extraordinary attorney and an even better person.

His brother Brian describes David as "brave but always fair; unwavering but kind." David was better at fighting for other people than he was for himself. He was always there for his friends, no matter the time or day.

Close friend Josh Thigpen said it best: "To be both the funniest and kindest person in the room is a rare gift. To lose that person is a rare and profound theft."

He will be deeply missed by all who knew him.

David Merrill Walters was a partner at The Walters Firm, where he dedicated his practice to serving businesses across Texas with particular focus on transportation, recovery services, and commercial operations. His approach to law was characterized by meticulous attention to detail, genuine care for his clients, and an unwavering commitment to justice.

Born on January 1, 1976, in Boston, Massachusetts, David spent most of his life in Austin, Texas. He was a graduate of Kirby Hall School in Austin and earned his Bachelor of Arts degree from Texas Christian University. He went on to attend South Texas College of Law in Houston, where his commitment to service and justice first became evident through his work providing free legal services.

After earning his Juris Doctor degree in 2005, David was admitted to the Missouri Bar and served as a Missouri Public Defender based in Poplar Bluff, where many of his family members resided. During his two years in Missouri, he was an active member of the First United Methodist Church in Poplar Bluff, where he also taught Sunday School.

Returning to Austin, David began law practice with his brother Brian. Together they built The Walters Firm into a respected practice known for excellence in commercial litigation and transportation law. Throughout his career, David never lost sight of his calling to help those in need, continuing to provide pro bono legal services and dedicating himself to community service.

Beyond his legal acumen, David was deeply committed to his community, serving as a board member for Uprise Circus and providing pro bono legal services through Texas Accountants and Lawyers for the Arts. His generosity of spirit and dedication to making a difference touched countless lives.

His brother and law partner, Brian Walters, described David as "brave but always fair; unwavering but kind" in his approach to their practice. "David was better at fighting for other people than he was for himself," Brian said. "He was always there for his friends, no matter the time or day."

David's practice centered on representing towing and storage companies in litigation, work that he approached with genuine passion and deep respect. He had a profound appreciation for the men and women who put their lives on the line every day to keep Texas roadways safe and handle the worst emergencies.

David understood that his clients were first responders in their own right—arriving at accident scenes, working in dangerous conditions, and providing essential services when others needed help most. He fought tirelessly to protect their interests and ensure they received the respect they deserved.

His brother Brian remembers David often saying, "Do you have any idea how lucky we are to work with clients we like so much?" That sentiment captured the essence of David's approach to law—he didn't just represent his clients, he genuinely cared about them and believed in the important work they did.

This deep respect and authentic connection with his clients made David not just an effective advocate, but a trusted advisor and friend to many in the towing and recovery industry across Texas.

Community Involvement

David was actively involved in community organizations that made a positive impact on the lives of others, particularly focusing on youth development and arts education.

Uprise Circus - Board Member

David served as a volunteer and board member for Uprise Circus, a nonprofit "social circus" organization in Austin. This innovative charity provides safety-net-protected training and performing in flying trapeze for disadvantaged and marginalized teens. The experience is proven to help teenagers gain confidence and self-esteem, and to bolster skills in teamwork and perseverance.

Texas Accountants and Lawyers for the Arts

During law school, David provided volunteer legal services through Texas Accountants and Lawyers for the Arts, offering pro bono legal assistance to artists, writers, musicians, and other creative professionals who might not otherwise have access to legal representation. This work earned him pro bono honors from South Texas College of Law. After returning to Austin to practice with his brother, David continued his commitment to this organization, providing gratis legal services throughout his career.

David is survived by his mother, Jane Barbour Walters of Austin; his brother and law partner, Brian (Cathy Doggett) Walters of Austin; and his sisters, Sarah Walters of Austin and Leslie Walters of Dassell, Minnesota. He is also survived by his nephews Jay, Nate, Mark, and Sam Reasbeck, all of Dassell, and Canyon Walters of Austin; and his niece Zayla Walters of Austin.

He was preceded in death by his father, Dr. Bob Walters, and his grandparents, Dr. and Mrs. Marvin (Rose Hammons) Barbour and Mr. and Mrs. Thurman Walters.

David's memory lives on through the countless lives he touched—as an attorney who fought tirelessly for his clients, as a volunteer who gave generously of his time and talents, as a brother and friend who was always there when needed, and as a man who made everyone around him feel valued and appreciated.
